Agreement Overview
This Terms and Conditions agreement (“Agreement”) is between you and On Time Bins LLC (“On Time Bins,” “we,” or “us”). By signing up, creating an account, or using any part of our services or platform, you acknowledge and agree to be legally bound by this Agreement, our Privacy Policy, and any related service terms found on our website or mobile platform.
Service Description
On Time Bins LLC is a California-based service company that arranges scheduled movement of trash and recycling bins for residents, homeowners, property managers, and short-term rental operators. We do not haul or dispose of trash. All can movement services are performed by our trained employees, known as “Binsters.” These individuals are hired, trained, and managed directly by On Time Bins.
Home & Property Access
When you request service, you give On Time Bins and its Binsters permission to access your designated property to retrieve and return trash and recycling containers as scheduled. Customers are responsible for ensuring clear access on service days, which includes but is not limited to:
- Providing any necessary access codes, keypads, or gate entry
- Ensuring pets are secured and do not obstruct access
- Removing any vehicles, obstructions, or hazards blocking access
Failure to provide access will result in skipped service, and no credit or refund will be given.
Service Terms
Based on your selected plan, your assigned Binster will transport your trash and/or recycling bins from their storage area to the curb prior to your scheduled municipal pickup and return them afterward. Any delay in city pickup due to holidays or route adjustments may impact our scheduling.
Bin Access & Preparation
It is your responsibility to ensure bins are accessible on the service day. You must:
- Unlock gates or garages, and disable alarms when necessary
- Keep bins in sanitary, safe, and movable condition
- Avoid overflowing bins or excessive trash around the containers
If access is restricted or bins are overloaded or unsanitary, service may be skipped with no refund issued.
Billing and Pricing
Service fees are charged in advance and recur based on the plan chosen at signup (monthly, quarterly, semi-annually, or annually). You authorize On Time Bins to charge your chosen payment method on file. We reserve the right to change pricing with a minimum of 30 days’ notice. Continued use of the service indicates your acceptance of updated pricing.
Payment Plans & Automatic Renewals
Your payment plan will automatically renew unless canceled in accordance with this Agreement. Payments will be charged at the beginning of each billing cycle. By providing your payment method, you authorize On Time Bins to process recurring payments.
Cancellation Policy
To cancel your subscription, a cancellation form must be submitted via our website. The following policies apply:
- Monthly Plans: Require at least 30 days’ notice prior to your next billing date.
- Quarterly Plans: Require 30 days’ notice. No refunds for unused portions of the quarter.
- Enterprise/Volume Accounts: Require 90-day written notice for cancellation of over 50% of properties.
No partial credits or refunds will be issued for time remaining in the billing cycle. Cancellations are confirmed via a confirmation number which must be retained as proof.
Garage Access & Liability
If you choose to allow access via garage, you assume all associated risks. You agree to:
- Provide a working code or remote
- Accept that On Time Bins is not responsible for theft, alarm disarming, or garage malfunctions
- Hold On Time Bins harmless for any claims involving garage entry, including property left unsecured
Pets
For the safety of our Binsters, pets must be restrained during scheduled service windows. If a Binster determines the property is unsafe due to a loose animal, service will be skipped without credit or refund.
Vehicles & Obstructions
You are responsible for ensuring bins can be moved safely. If a vehicle or other object blocks access or damages bins or property, On Time Bins is not liable for resulting damages.
Weather & Road Conditions
In cases of inclement weather or road closures preventing access to your property, service may be delayed or canceled without notice. No refunds will be provided under such circumstances.
Trash Can Cleanliness
Bins must be kept in sanitary condition. If Binsters deem bins unsafe to handle due to excessive odor, contamination, or pest infestation, service may be refused. Customers will be notified and expected to resolve the issue before the next visit.
Force Majeure
Neither party shall be liable for delay or failure in performance caused by circumstances beyond reasonable control including, but not limited to, natural disasters, labor disputes, utility failures, pandemics, or civil unrest.
Liability Limitations
To the maximum extent permitted by law, On Time Bins disclaims liability for indirect or incidental damages. Our total liability is limited to the amount paid by you for services in the 12 months prior to the issue. We are not responsible for missed services due to issues such as access, pet interference, bin overloads, or force majeure.
Messaging Terms
By enrolling, you agree to receive service-related SMS messages or emails. Message frequency may vary. You may unsubscribe at any time by texting “STOP.” Standard message and data rates may apply. Your mobile carrier is not responsible for delayed or undelivered texts.
Changes to Terms
We reserve the right to update these Terms at any time. Revisions will be posted to our website. Continued use of services after changes are posted constitutes acceptance of the updated Agreement.
